A. Reports on the bills and resolutions passed in the
2012 Regular Session, Hawaii State Legislature

1	HB 2012 HD1 SD1 CD1 Act 106 (SLH 2012) Section 4 (11) amending Part III, Act 164 (SLH 2011) adding new Section 18.2 See pg. 256 of (SLH 2012)	Relating to State Budget	New section 18.2 added to Act 164 (SLH 2011): Provides EDN400 with $25M for fiscal year 2012-2013 for DOE home-to-school transportation costs not mandated by state or federal law but only if certain conditions are met, BOE approval, all four counties included, and report with specific requirements is submitted 30 days prior to 2013 Regular Session. See also below: amendment to Section 20 in part III, Act 164 (SLH 2011).
2	HB 2012 HD1 SD1 CD1 Act 106 (SLH 2012) Section 15 of Act 106 (SLH 2012) amending Part VII Act 164 (SLH 2011) adding new Section 131.1	Relating to State Budget	Adding new Section 131.1 to Part VII of Act 164 SLH 2011 requiring a report re: fiscal years 2009-2010 to 2011-2012 DOE amount & proportion of operating budget expended for administrative costs and amount & proportion and expended by principals and DOE plan to comply with section 302A-1301(b).
3	HB 2012 HD1 SD1 CD1 Act 106 (SLH 2012) Section 15 of Act 106 (SLH 2012) amending Part VII Act 164 (SLH 2011) by adding new Section 133.2	Relating to State Budget	Adding new Section 133.2 to Part VII Act 164(SLH 2011); every executive department and agency shall prepare a report on overtime use using Budget & Finance format. Submit report to B&F for compilation.
4	HB 2012 HD1 SD1 CD1 Act 106 (SLH 2012) Section 15 of Act 106 (SLH 2012) amending Part VII Act 164 (SLH 2011) by adding new Section 133.3	Relating to State Budget	Adding new Section 133.3 to Part VII Act 164(SLH 2011); every department and agency shall prepare a report on overpayments using Budget & Finance format. Submit report to B&F for compilation.
5	HB 2273 SD1 Act 297 (SLH 2012)	Relating to Concussions	DOE and HHSAA develop concussion education program, including annual awareness training, removal from sports, written clearance; DOE report to legislature 20 days prior to 2013 Regular Session on development and implementation of concussion educational program.
6	HCR 85 (HR59) (2012)	Hawaiian Studies Audit Compliance	BOE and DOE mandated to comply in full with the Findings and Recommendations of the State Auditor: 1) allocate resources to develop fundamental requirements of K-6 programs & complete, disseminate and implement 5 yr. strategic plan; 2) update and revise Hawaiian studies program & curriculum guides for K-6; 3) monitor funds; 4) make clear statement of rule of kupuna and makua & regular classroom teacher; 5) allocate substantive resources to kupuna and makua training and educational programs; 6) provide accounting of all expenditures; BOE & DOE report due to Leg 20 days prior to 2013 Regular Session.
7	HCR 178 (HR 139) (2012)	Requesting a Report of All State Department Expenditures Relating to Energy Conservation Contracts and Power Purchase Agreements	Each State department is requested to report to B&F on energy conservation contracts and power purchase agreements; DOE provide detailed analysis to the legislature through B&F on its power purchase agreements; B&F submit findings and recommendations no later than 20 days prior to 2013 regular session.
9	SCR 79 (2012) same as SCR 145 (2011)	Requesting the Board of Education and Department of Education to Collaborate with Parent Organizations to Establish, Implement, and Monitor Statewide Policies For Family Engagement in Hawaii's Public Schools	BOE & DOE requested to collaborate with parent organizations re: statewide policy for family engagement; BOE & DOE report finding and make recommendations, including proposed legislation to the legislature no later than 20 days prior to 2013 regular session.
10	SCR 80 (2012)	Requesting the DOE to Conduct Research on the Correlation between Children Who are Late-born and Educational Outcomes	Request DOE conduct research regarding late-born children and educational outcomes; collaborate with Governor's Early Learning Coordinator, institutions of higher learning and regional education laboratory; report to Leg no later than 20 days prior to 2013 session.
11	SCR 120 (2012)	Requesting the BOE and DOE to Apply to the U.S. DOE for a Waiver of the Requirements of the No Child Left Behind Act	Requesting BOE and DOE apply for Waiver from No Child Left Behind Act ; BOE and DOE develop plan to improve and attain high school achievement to support waiver application; BOE and DOE provide update to President of Senate, Speaker of House & Chairs of Education Committees once application for waiver is filed and when any responses received; BOE and DOE conduct informational briefing on status of waiver before Senate and House Committees during 2013 Regular Session.
12	HB 200,HD1,SD1,CD1 Section 41 Act 164(SLH 2011)	Relating to the State Budget	Report on EDN 400 special funds appropriation for school support detailing each permanent and non-permanent CIP related positions by number, position, title, and compensation (including fringe benefits).
13	HB 945,HD2,SD1,CD1 Act 52(SLH 2011)	Relating to School Year and Instructional Time	Report on the following for public schools excluding charter and multi-track schools which shall implement a school year of 180 days and: (1) For SY2011-12: 50% elementary schools shall implement 915 student instructional hours; (2) For SY2012-13: All elementary schools have 915 hours; (3) For SY2014-16: All secondary schools shall implement 990 hours; (4) For SY2016-18: All public schools shall implement 180 days school year, excluding PD days negotiated, including 1080 student instructional hours for both elementary and secondary school grades. The BOE shall adopt policies and procedures and may grant a waiver to any individual school subject to the student instructional hours or 180 day school year requirement.
14	SCR 79,SD1 (2011)	Requesting the BOE to review its by-laws and policies and applicable administrative rules and statutes to improve the effectiveness of the educational delivery system	Report on findings to BOE by-laws and policies including changes. Final report on subject matter.
15	SCR 145 (2011) See SCR 79(2012)	Requesting the BOE and DOE to collaborate with parent organizations to develop statewide policies for family engagement for Hawaii's public schools	Report on findings and recommendations regarding subject matter. Report due to 2013 legislature for SCR 79(2012) continue collaboration with parent organizations; report to legislature due no later than 20 days prior to 2013 regular session.
16	HB 0019 Act 245 (SLH 2007)	Relating to Education	Annual report on implementation of the school impact fees act.
17	SB 2004 Act 179 (SLH 2008)	Relating to Education	Annual report on total number of requests for a due process hearing relating to the reimbursement of costs for a child's placement filed by a parent or guardian of a child with a disability.
18	SB 2878 Act 14 (SLH 2008, Special Session)	Relating to Early Learning	Annual report to Legislature and Early Learning Council on number of classrooms suitable for programs and services in the early learning system and cost of renovating those classrooms to meet standards.

20	Section 302A-1004, HRS	(b) Comprehensive Accountability System	Annual report of the specifics of the implementation of the comprehensive accountability system, as well as the fiscal requirements and legislative actions necessary to maintain and improve the accountability system.
21	Section 304A-1202, HRS	Annual Report on the Teacher Education Coordinating Committee	Report on activities relating to:1) The development of strong teacher training programs at accredited institutions of higher learning in Hawaii and; 2) Addressing issues and concerns regarding teacher preparation and other educational matters related to improving education in the State of Hawaii.
22	Section 302A-620, HRS	Classification/Compensation Appeals Board	Even-numbered years' report on the classification/compensation plan and related cost. [Appeals Board final adjustment to classification/compensation plan due to Supt by first Wednesday of December in even numbered years which is December 5, 2012, then Supt also include costs in report to Gov/Leg.]
23	Section 302A-1504.5 Act 133 (SLH 2012), Act 31 (SLH 2010) & Act 150 (SLH 2011)	School-level Minor Repairs and Maintenance Special Fund	Annual report to Director of Finance 90 days after close of FY identifying total amount of funds in school-level in or R&M special fund that carries over to next fiscal year on funds in each school account and carry over to next FY. Copy of report to legislature.
24	Section 29-25, HRS	Federal and Trust Funds	Annual report on the exAct amount and specific nature of federal impact aid, U.S. Department of Defense funds, and federal indirect overhead reimbursements received.
25	Section 302A-1405, HRS	Federal Grant Search, Development, and Application Revolving Fund	Annual report on the status of federal grant search, development and application revolving fund.
27	Section 37-41.5, HRS	Carry over of Funds	Annual report on total amount of funds.
28	Section 37-74 (d) HRS Act 051 (SLH 2004)	Transfers Performed Between Programs and Agencies Transfers of Appropriated Funds and Positions	Quarterly reports to Governor on subject matter and annual report to Governor and Legislature.
29	Section 36-32, HRS	State Educational Facilities Improvement Special Fund	Report on the financial statement of the special fund, lease payments for schools account established, and the status of projects undertaken pursuant to this section.
30	Section 36-35 Act 133(SLH 2012) amended by deleting as prescribed by Section 302A-1505	State Educational Facilities Repair and Maintenance Account	Annual report of account finances and status of R & M projects undertaken. Project expenditures shall be posted electronically on the Internet within 30 days of each project's completion.
31	Section 302A-1312 amended by Act 133 in §26(SLH 2012) by deleting (c) (1): no need to include priority listing in the annual report	Six-Year Program and Financial Plan for School R & M	Annual report on Six-Year Program and Financial Plan for School R & M including annual funding requirements. Also develop and maintain facilities physical analysis report for each public school posted electronically on the Internet.
> 32	Section 21, Act 130(SLH2012)	Relating to Charter Schools	Annual report on the State's public charter schools for the school year ending in the preceeding calendar year.
